Overview of the job

makes us proud to be part of HMPPS. Despite this, we all know that unacceptable
behaviour - discrimination, bullying, harassment and victimisation (BHDV) - happens
across all areas in HMPPS, as it does in many organisations. The Tackling
Unacceptable Behaviours Unit (TUBU) aims to improve our working environment,
support staff experiencing unacceptable behaviours to access the right help and to
support managers dealing with unacceptable behaviours and bringing positive
change.
TUBU’s specialist investigation service enables managers from across HMPPS to
access qualified investigators, and/or assistance for more complex and sensitive
BHDV cases. The Tackling Unacceptable Behaviours Unit (TUBU) is based in HQ, but
covers the whole of England and Wales and as such can either be London-based, or
regional.
Summary
The post holder will be accountable to the TUBU Head of Casework and will lead
complex and sensitive investigations into bullying, harassment, discrimination and
victimisation across HMPPS.
This is a fast-paced, challenging role that requires a highly proactive and flexible
approach to the work and provides a high level of autonomy. The post holder is
responsible for ensuring individual cases are investigated to a high standard, and for
identifying industry best practice, directly informing investigatory practice across
HMPPS. Improving the quality of these difficult and sensitive investigations is pivotal
to driving positive behaviour change across the Service, improving working
conditions for all staff. High quality investigations improve disproportionate
outcomes, reducing risk of reputational damage and increasing confidence of all
parties involved in the investigation process.
The cases the post holder will be required to deal with will be highly sensitive as well
as emotionally challenging, including those attracting high public interest. The post
holder will be required to deal with these in an expert, confidential and professional
manner.
It involves a considerable amount of time engaging with individuals at all levels
across HMPPS, especially with Senior Leaders. The role holder will be expected to
make recommendations based on the evidence, taking into account the relevant
HMPPS polices and employment law.
The role has an impact on practice and influencing policy across the service.
Responsibilities,
The job holder will be required to carry out the following responsibilities, activities

• Investigate high profile BHDV cases of a complex and/or sensitive nature from
across HMPPS. These will include investigations involving senior members of
staff and cases of high public interest. Prepare and submit completed evidential
files and investigation reports, observing the highest professional standards.
Attend and give evidence to Employment Tribunals and Coroners’ Inquests.
• Provide defensible and thoroughly evidenced recommendations to
Commissioning Managers regarding the appropriateness of investigation, Terms
of Reference, and recommended outcomes. Challenge these senior leaders
where necessary to ensure that the investigation proceeds in line with HMPPS

policies and the relevant legal frameworks. Provide separate management
reports identifying wider issues outside of the individual case as appropriate.
• Work in close collaboration with the MoJ High Profile Complex Investigations
Team, Government Legal Department, key stakeholders and other government
departments to improve the quality of investigations across HMPPS, sharing
good practice across Government.
• Triage referrals coming into the unit to ascertain whether they meet TUBU
criteria. Assess resourcing implications and team capacity before providing a
response to the referring business unit.
• Produce a flexible Continuous Professional Development (CPD) strategy for the
Investigator SPOCs across HMPPS. Ensure this is in line with the strategic
direction of the business and is regularly updated to incorporate new lessons
learnt.
• Overall accountability for the analysis of large national datasets, both
quantitative and qualitative, producing recommendations and reports. Produce
national level outputs that directly influence, inform and impact on organisation
wide objectives, policies and procedures throughout HMPPS, reporting to
HMPPS Leadership Team.
• Develop and deliver training courses, masterclasses and toolkits for senior
leaders and managers across HMPPS , ensuring they are in line with industry
standards and the law.
This role will require travel and flexibility in working practices. The duties/
responsibilities listed above describe the post as it is at present and is not intended
to be exhaustive. The job holder is expected to accept reasonable alterations and

An ability to fulfil all spoken aspects of the role with confidence through the medium
of English or (where specified in Wales) Welsh.

Technical
• Must hold the ILM National Certificate in Workplace Investigations or the
willingness to study within six months of appointment.
• Must hold an Investigation Qualification at minimum BTEC level 7 or the
willingness to study within the first six months of appointment.
